TERMS OF USE

Welcome to Creadev – a no-code platform for creating games and interactive experiences. These Terms of Use (“Terms”) govern your access to and use of the services provided by Creadev Technologies Inc. (“Creadev”, “we”, “us”, or “our”), a company incorporated in British Columbia, Canada, through our website located at https://www.creadev.net (“Site”).

By accessing or using Creadev, you (“User”, “you”, or “your”) agree to be bound by these Terms. If you do not agree to these Terms, you must not access or use the Platform.

1. Eligibility

To use Creadev, you must be at least 13 years old or the minimum age required in your jurisdiction to provide consent to use online services. By using the Platform, you represent and warrant that you meet this requirement.

2. Account Registration

To access certain features, you must register for an account. You agree to provide accurate, current, and complete information and to keep your account credentials secure. You are responsible for all activity that occurs under your account.

3. License and User Content

3.1. License to Use Platform

Subject to these Terms, Creadev grants you a limited, non-exclusive, non-transferable license to access and use the Platform for your personal or commercial purposes, in accordance with your subscription level.

3.2. User Content

You retain ownership of any games, assets, code, text, images, or other content (“User Content”) you create using Creadev. By uploading or publishing content through the Platform, you grant Creadev a worldwide, royalty-free license to host, store, display, and distribute your content solely for the purpose of operating the Platform and providing support.

You are solely responsible for your User Content and represent that you have all necessary rights to upload and use such content.

4. Acceptable Use

You agree not to:

Use the Platform for any unlawful, harmful, or fraudulent purpose.

Upload or distribute content that is defamatory, infringing, or otherwise violates any law or third-party rights.

Reverse engineer, decompile, or attempt to extract source code from the Platform.

Interfere with or disrupt the operation of the Platform or servers.

We reserve the right to suspend or terminate your account for violations of this section.

5. Subscription and Payment

Certain features of the Platform require a paid subscription. By subscribing, you agree to pay all applicable fees and taxes. Fees are non-refundable except as required by law. We may modify our pricing and subscription structure with notice.

6. Termination

You may terminate your account at any time. We reserve the right to suspend or terminate your access to the Platform at our discretion, with or without notice, including if you violate these Terms.

Upon termination, your access to your User Content may be revoked, but we will use commercially reasonable efforts to allow you to export it.

7. Intellectual Property

All intellectual property rights in the Platform and its content (excluding User Content) are owned by Creadev Technologies Inc. or its licensors. You may not copy, modify, or distribute any part of the Platform without express written permission.

8. Disclaimer of Warranties

Creadev is provided on an “as is” and “as available” basis. We make no warranties, express or implied, regarding the Platform’s availability, reliability, or fitness for a particular purpose.

9. Limitation of Liability

To the maximum extent permitted by law, Creadev Technologies Inc. shall not be liable for any indirect, incidental, or consequential damages arising out of or related to your use of the Platform.

10. Indemnification

You agree to indemnify and hold harmless Creadev Technologies Inc., its officers, directors, and employees from any claims, damages, or expenses arising from your use of the Platform or your violation of these Terms.

11. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the Province of British Columbia and the laws of Canada applicable therein. You agree to submit to the exclusive jurisdiction of the courts in British Columbia.

12. Changes to Terms

We may update these Terms from time to time. We will provide notice of any material changes, and continued use of the Platform after such changes constitutes your acceptance of the revised Terms.
